1. Introduction

Australian Postal Corporation (Australia Post), owns this Growing Global Portal (Portal). By accessing or using the Portal, you (the user of the Portal) agree to the terms of use (Terms of Use) of the Portal as set out below. If you do not agree to these Terms of Use you must immediately cease using the Portal.

The Terms of Use include the terms and conditions set out below, the Australia Post Terms and Conditions, and the Australia Post Privacy Policy.

You are bound by these Terms of Use and should review them whenever you are using the Portal. These Terms of Use apply to all users that access the Portal.

If you are a service provider that Australia Post has nominated to list services for sale on the Portal (Seller), your use of the Portal will also be subject to a separate agreement with Australia Post (Seller Agreement). To the extent of any inconsistency between the Seller Agreement and these Terms of Use, the Seller Agreement will prevail.

2. The Portal

The Portal is a platform for users to engage Sellers to provide services connected with conducting business in jurisdictions other than Australia (Services). The Portal also contains information about doing business overseas.

Australia Post is responsible for hosting and administering the Portal. It is not responsible for, and accepts no liability in respect of:

(a) any Services offered or provided by any Seller;

(b) any acts or omissions of any Seller; or

(c) any article, content or other information that appears on the Portal.

The Portal is provided on an “as is” basis. Australia Post does not guarantee that access to the Portal will be uninterrupted or that the Portal is free from viruses or anything else which may damage any computer or other device which accesses the Portal or any data on such a computer or device.

You must not provide any information that is commercially sensitive or otherwise confidential via the Portal, unless the information is necessary for you to use the functionality of the Portal. You must use your discretion regarding the information that you provide or make available to others on or through the Portal. Except for information provided to Australia Post during the application and registration process (that is not made publically available through ordinary use of the Portal without your express permission) (registration information), Australia Post does not undertake to keep any information on the Portal confidential - this includes any data, questions, comments, suggestions, ideas or other information. You license Australia Post, on a worldwide, irrevocable basis to use such material (except for registration information) for any purpose without providing notice or compensation to you. 

You may elect to correspond with Sellers via the Portal or outside the Portal (via email or phone).

Any information provided by you via the Portal, or posted to the Portal must, to the best of your knowledge:

(a) not contain anything that is false, misleading or deceptive;

(b) not infringe the rights (including intellectual property rights) of any person; and

(c) comply with all laws and regulations.

Any correspondence via the Portal is at your own risk and Australia Post is not liable for the use of the Portal for such communications. Australia Post is not required to independently confirm the accuracy or completeness of any information provided by Sellers in correspondence over the Portal and is not liable for any representations made by Sellers over the Portal.

3. Content on the Portal

The articles and country and industry modules available on the Portal are not written by Australia Post. This content was provided by Australia Post’s third party content provider, APCO Worldwide.

The articles and other country specific content available on the Portal have not been independently verified by Australia Post. Australia Post makes no representations and gives no guarantees as to the accuracy, currency, completeness, usability or reliability of the information in the Portal and accepts no responsibility for any errors or omissions in the contents of the Portal at any time. In no event will Australia Post (or its officers, agents, contractors or employees) be liable for any information contained on or referred to on the Portal and will not be liable for any loss or damage which may be incurred as a result of using or relying on any information or material presented on or accessed from the Portal, including (without limitation) the contents of the Portal.

You acknowledge and agree that:

(a) you will exercise your own independent skill and judgment before relying on any of the information available or referred to on or through the Portal;

(b) information provided over the Portal is for general information purposes only and is not intended to provide specific advice for your business needs;

(c) information provided over the Portal is not intended to constitute legal advice, and you must procure your own independent legal advice in respect of any particular legal question or issue you may have;

(d) Australia Post recommends that you obtain applicable professional advice before you make any decisions based on information obtained from the Portal; and

(e) information on the Portal was prepared at a point in time, as specified on each Portal article, and may be out of date and inaccurate at the time that you access the Portal.

All content on the Portal is subject to change at any time without notice.

You may access, download and print content from this Portal for your own personal or internal business purposes only. You must not publish, adapt, communicate to the public, distribute to third parties, amend or make any other copy of any part of the content on this Portal without our prior written consent.

4. Engaging Sellers over the Portal

The Portal allows you to engage Sellers to provide Services. Australia Post has selected one Seller per service category to recommend via the Portal. In some cases, Australia Post’s nominated Seller will be an Australia Post service or affiliate. In other cases, Australia Post’s nominated Seller for a service category will be a third party Seller. Australia Post has arrangements in place with each third party Seller under which Australia Post receives a commission on any Services you purchase from Sellers via the Portal.

If you use the Portal to engage any third party Sellers to provide Services, this engagement will be governed by the third party Seller’s terms of service. Australia Post is not involved in the transaction between you and the third party Seller, except to the extent Australia Post transfers your payment to the Seller.

If you use the Portal to engage any Australia Post service or affiliate to provide Services, additional terms of service may apply to this transaction.

Australia Post has no liability for the quality of the Services supplied by any third party Sellers, the truth or accuracy of any third party Sellers’ listings or descriptions, or the ability of any third party Sellers to provide the Services advertised. You accept sole responsibility and all risk in engaging any third party Seller and/or using any Services.

For some Sellers, Australia Post will act as a conduit and collect your payment for Services on behalf of the Seller. Australia Post does not have any control over third party Seller pricing for Services. The Seller is solely responsible for providing you with an invoice for the Services, and Australia Post (and its officers, agents, contractors or employees) will have no liability for any failure of a third party Seller to issue you with an invoice. In no event will Australia Post (or its officers, agents, contractors or employees) be liable to you or any third party for any loss or damage which may be incurred by you or a third party in connection with the use or failure of any third party payment platforms or systems.

5. Personal information

Australia Post will only use your personal information in accordance with Australia Post's Privacy Policy. As part of a transaction, Sellers may obtain your personal information, including email address and shipping information.

By using the Portal, you consent that personal information obtained through a Portal transaction may be used for the purpose of completing that transaction, for Australia Post related communications and, other promotional material Australia Post is allowed by law to send you from time to time.

6. User Eligibility

You must be at least 18 years of age to use the Portal (even if you are acting on behalf of another person) and able to form legally binding contracts under applicable law, or be under the supervision of a parent or guardian who is at least 18 years of age. By using this Portal you represent and warrant that you are at least 18 years of age and that all registration information you submit is accurate and truthful. Australia Post may, in its sole discretion, refuse to offer access to or use of the Portal to any person or entity and change its eligibility criteria at any time by providing you with 10 business days’ notice.

You are solely responsible for providing (at your cost) all equipment, software and internet access necessary to use the Portal and/or the Services.

7. Account Security

You must sign up to a My Post Business Account to purchase Services through the Portal. The My Post Business Account terms apply, including in relation to the security of your account. You will be liable for, and indemnify Australia Post for any loss or damage resulting from your failure to maintain password confidentiality. It is your responsibility to keep your account information up-to-date and accurate at all times. MyPost Business Account means an account registered by a customer on the Australia Post website as defined in the MyPost Business Account terms and conditions.

8. External Websites and Links

Australia Post is not responsible for the content or availability of outside websites or resources linked to or referenced on the Portal. Australia Post does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such websites or resources. You agree that Australia Post shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or resources.

9. Dispute Resolution and Queries

If you are not satisfied with the Services provided by any third party Seller, you must engage directly with that third party Seller to resolve your complaint. Australia Post is not responsible for enforcing any rights that you may have against any Seller.

Australia Post may provide reasonable assistance in facilitating a resolution to your dispute with another user of the Portal (including by providing information to you).

If you have a concern or dispute arising in connection with the hosting or administration of the Portal please contact us at smallbusiness@auspost.com.au.

All order queries should be directed to the relevant Seller.

10. Termination

Without limiting any other remedies Australia Post may have under these Terms of Use or at law, Australia Post may remove any of your content from the Portal, issue a warning, temporarily or indefinitely suspend your account and privileges, terminate your account, prohibit access to the Portal, take technical and legal steps to prevent use of the Portal

if any of the following apply:

  • Australia Post reasonably suspects you have breached these Terms of Use or any other terms and conditions incorporated herein;
  • Australia Post reasonably suspects that you have provided false personal information via the Portal;
  • you have engaged in improper or fraudulent activity in connection with the Portal; or
  • your actions may cause legal liability or financial loss to the Portal's users or to Australia Post.

Without limiting the above, Australia Post has the right to terminate or suspend the operation of the Portal (including in part) for any reason without liability upon 5 business days’ prior written notice to you. Australia Post may (without limitation) suspend the Portal to conduct maintenance or to implement updates.

11. Limitation of liability

To the maximum extent permitted by law Australia Post, its officers, agents, contractors and employees exclude completely all liability whatsoever for any loss or damage of any kind (including special, indirect or consequential loss and including loss of business profits) however caused (including negligence) arising out of or in connection with the Portal, the content or the use or performance of the Portal, or any Services procured by you via the Portal. Australia Post, its officers, agents, contractors and employees are not liable for any loss of data, money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of your use of or your inability to use the Portal.

You acknowledge and agree that Australia Post, its officers, agents, contractors and employees are not responsible for nor have any liability in respect of the provision or the outcome of any Service procured or supplied through the Portal and you will hold Australia Post, its officers, agents, contractors and employees harmless inrespect of any dealings with any Seller, including (without limitation), the outcome of any Service(s).

You agree to indemnify Australia Post, its officers, agents and employees in respect of any claim, action, damage, loss, liability, cost, charge, expense, outgoing or payment (including legal expenses (on a full indemnity basis) arising from or relating to:

  • your use of the Portal or any content you submit through the Portal;
  • any claims made against Australia Post, or its officers, agents, contractors and employees, in connection with your use of the Portal, any Service, or any of your dealings with any Seller; or
  • your breach of any applicable law.

To the fullest extent permitted by law, Australia Post excludes all warranties, representations, implied terms and guarantees about the currency, accuracy, suitability, functionality or reliability of the Portal.

In respect of any conditions, warranties and guarantees which cannot be excluded under statute, to the extent permitted by law, the liability of Australia Post for a breach of such condition, warranty or guarantee is limited (at its option) to the resupply or a refund of the cost of the relevant services.

12. Legal Compliance and Taxes

You must comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Portal and any Australia Post service and, if applicable, your listing, purchase, solicitation of offers to purchase, and sale of Services. In addition, you shall be responsible for paying any and all taxes applicable to any purchases or sales of Services you make on the Portal.

13. Severance

Part or all of any provision of these Terms of Use that is invalid or unenforceable may be severed from the remaining terms and conditions, and the remaining provisions of the Terms of Use continue in force.

14. Portal

Australia Post reserves the right to alter these Terms of Use or other Portal terms and conditions at any time, so please review these Terms of Use frequently. If Australia Post makes a material change the Portal will notify you here, by email, by means of a notice on our home page, or other places Australia Post deems appropriate. What constitutes a "material change" will be determined at Australia Post’s sole discretion.

15. Jurisdiction

These Terms of Use are governed by and construed in accordance with the laws of the State of Victoria, Australia. In the event that a dispute arises from these Terms of Use, you agree to submit to the non-exclusive jurisdiction of the courts of Victoria, Australia.

16. General

Australia Post may assign its rights and obligations under these Terms of Use to another entity upon 5 business days’ prior written notice to you. Australia Post will let you know if it undertakes any such assignment by email, by means of a notice on our home page, or other places Australia Post deems appropriate.

Our failure to act on a breach by you or others doesn't waive our right to act on subsequent or similar breaches.

These Terms of Use contain the entire understanding and agreement between you and Australia Post.
