The Australian Postal Corporation (“Australia Post”) offers custom packaging on the Australia Post Online Shop website (“Website”) and will procure from third party suppliers the Services ordered on the Website. Before placing your order, please read through these Terms of Use.

By using Custom Packaging, you agree to be bound by the terms and conditions set out in:

(a) these Terms of Use;

(b) the Online Shop Terms and Conditions;

(c) the MyPost Account Terms of Use;

(d) the Australia Post Terms and Conditions;

(e) the Australia Post Privacy Policy.

Unless otherwise stated in these Terms of Use, if there's any inconsistency between any of the above documents, the earlier mentioned document will take precedence to the extent of that inconsistency.

1. Ordering the services

The “Website” means the Australia Post Online Shop website on which the Services can be purchased.

The “Services” means the custom printing and packaging services as described on the Website which are available for supply to you.

You may place an order for the Services in the manner required on the Website. To place an order, you must sign into, or create, a MyPost Account. “MyPost Account” means an account registered by you on the MyPost website, at a Post Office or via the Australia Post app.

Once your order has been submitted it cannot be cancelled, withdrawn or refunded, except as required by the Australian Consumer Law. On receiving your order, Australia Post will procure that it will be supplied directly to you by one of its authorised suppliers in the form uploaded and selected by you on the Website.

2. Invoicing and payment

You must pay the required fees for your order at the time your order is placed. Payment is made using the payment method which you select from those identified and which are available on the Website.

Australia Post will provide you with an invoice in respect of your payment as soon as possible after your payment has been received and your order is processed.

The prices on the Website for the Services are stated to be inclusive of goods and services tax (GST) at the applicable rate. GST will be itemised separately on Australia Post’s invoices.

3. The Website - use, content and access

3.1 Australia Post will take reasonable care in preparing and maintaining the information on this Website and will use all reasonable endeavours to maintain the Website and ensure it is and remains accurate. However, Australia Post does not warrant the accuracy, reliability, adequacy or completeness of any of the Website content.

3.2 The Website content is subject to change at any time without notice and on occasions may not necessarily be up to date. Australia Post does not guarantee that access to the Website will be uninterrupted or that the Website is free from viruses or anything else which may damage any computer which accesses the Website or any data on such a computer.

3.3 Australia Post will be entitled to use information and materials you send to Australia Post on or via the Website (including any data, questions, comments, suggestions, ideas or other information) for the purposes of fulfilling your order or for our reasonable business purposes insofar as such use is not inconsistent with our obligations under law or clause 5.1 and clause 8 of these Terms of Use.

4. User eligibility

4.1 By placing an order for the Services, you warrant that you are authorised to do so on behalf of the person, business or entity in whose name an order is placed.

4.2 By using the Website, you represent and warrant that you are at least 18 years of age and that all information you submit is accurate. Australia Post may, at its option, refuse to offer access to or use of the Website and the Services to any person or entity and change its eligibility criteria at any time. Australia Post will provide the person or entity that has been refused access or use of the Website with written notice where reasonably practicable.

5. Materials supplied and Intellectual Property

5.1 By submitting materials to Australia Post on the Website, you warrant that you hold all required rights (whether though ownership or licence rights) to supply such information and for such materials to be used in connection with supplying your order. You hereby grant Australia Post and its third party suppliers such licence (or sub-licence) rights as reasonably required to supply your order.

5.2 Australia Post has the right in its absolute discretion to reject any materials, whether in writing or as images, submitted by you on the Website, whether in connection with your order or otherwise, which may reasonably be considered offensive, defamatory, violent, blasphemous, material that could infringe copyright or which contains any profanity.

6. Reviewing your order

6.1 Packaging wrapping: Upon uploading your image, our system automatically crops your image, so that it fits with the proportions of the packaging size you have selected. We provide a preview showing how your image will appear on the packaging. Please be sure to preview and edit your packaging to ensure it appears correctly or upload a different image. Our system will prompt you to check an approval box before you check out and finalise payment. Once you approve the packaging, you are confirming that it appears exactly as you want it, and as a result, we cannot guarantee replacements or refunds if the packaging matches the preview that was approved when you placed your order.

6.2 Colour Reproduction: Colours may not appear the same on different computer monitors, compared to your computer, camera, phone or tablet. Colours shown on screen may change and appear muted or desaturated when printed, especially when printed on kraft cardboard packaging. Australia Post reproduces colour from the images and/or text as closely as possible but may not be able to exactly match colour and density because of limitations in the printing process and image resolution requirements. Please note that Australia Post cannot guarantee colour reproduction or image quality.

6.3 Your responsibility: You are responsible for creating, reviewing and approving your order on the Website. Please review the packaging carefully before placing your order, including ensuring that images, logos, text and shapes are clear and where you want them to be and that text is clear, legible and spelled correctly. It is your responsibility to ensure that your order is complete, accurate and complies with these Terms of Use. Australia Post, nor any third party supplier, is responsible for reviewing or amending any order.

6.4 Acknowledgements: You acknowledge that the quality of the packaging and/or the image on the packaging may differ depending on the quantity ordered and the authorised supplier. Samples are digitally printed, are only an indication of the final packaging and may differ slightly from the final packaging order.

6.5 Product queries: If you have a query arising from product or shipping issues, please call 1800 331 794. We recommend you contact us as soon as possible and no later than 5 business days from receipt of your order. This provision does not limit any rights or remedies you may have under the Australian Consumer Law.

7. Delivery standards

7.2 Delivery Australia Post’s authorised suppliers determine the way the Services will be delivered to you, as well as the provider of that delivery. If the delivery is performed by Australia Post, the carriage of articles will be governed by the Australia Post General Terms and Conditions.

9. Termination

9.1 Termination without Cause

Unless provided otherwise on the Website or required by the Australian Consumer Law, orders cannot be cancelled, terminated or withdrawn once they have been placed.

9.2 Termination for Breach

Without limiting any other remedies, Australia Post may temporarily or indefinitely suspend or prohibit your access to the Website, any orders, any privileges, terminate a user's account and take technical and/or legal steps to prevent your use of the Website and/or refuse to provide the Services if any of the following apply:

a. Australia Post reasonably suspects you have committed a material breach of these Terms of Use;

b. Australia Post is unable to verify or authenticate any of your details of required personal information;

c. Australia Post reasonably considers that you have engaged in improper or fraudulent activity; or

d. Australia Post reasonably considers that your actions will cause material harm or otherwise adversely impact its commercial reputation.

Australia Post will provide you with written notice where reasonably practicable following Australia Post taking any of the above actions.

10. Limitation of liability

To the maximum extent permitted by law, including the Australian Consumer Law, Australia Post excludes all liability for loss or damage of any kind (including special, indirect or consequential loss and including loss of business profits) however caused (including negligence) arising out of or in connection with the Services, the Website, its content or the use or performance of the Website, except to the extent that the loss or damage was caused by or arose out of any fraud or wilful misconduct by or on behalf of Australia Post.

11. General

11.1 Assignment. You may not assign or transfer your rights under these Terms of Use, or attempt or purport to do so, without our prior written consent (which may not be unreasonably withheld).

11.2 Force majeure. Neither party will be liable to the other for any failure to fulfil, or delay in fulfilling, its obligations caused by circumstances outside of its reasonable control.

11.3 Governing law. These Terms of Use are governed by and interpreted in accordance with the laws of the State of Victoria, Australia, and both of us submit to the jurisdiction of the courts of that State.

11.4 Severability. If any provision, or part of a provision, of these Terms of Use is found to be illegal or unenforceable, it will be severed from the agreement, and the remainder of the terms will be construed as if that provision or part did not form part of the Terms of Use. The previous sentence will not apply if the provision or part to be severed constitutes a material and fundamental element of the agreement between the parties.

11.5 Variation and modification. Australia Post reserves the right to modify or terminate the Website and the Service for any reason at any time subject to giving you (and all uses) reasonable notice. Australia Post reserves the right to alter these Terms of Use or other Website terms and conditions at any time. If Australia Post makes a material change Australia Post will notify you, and the notice may be, by email, by means of a notice on the Website, or other places Australia Post deems suitable and appropriate. What constitutes a "material change" will be determined at Australia Post’s discretion.

Your continued use of the Services after we have notified you of an amendment will mean that you agree to that amendment.
